(II) A FORMER MEMBER WHO IS ELIGIBLE FOR A
SERVICE RETIREMENT ALLOWANCE AT THE TIME SERVICE IS
TERMINATED MAY RECEIVE THE SERVICE RETIREMENT ALLOWANCE AS
OF THE FIRST DAY OF THE MONTH FOLLOWING RECEIPT OF THE
WRITTEN APPLICATION.

Article 88B - State Police

53.

(1) (a) (I) Any member may retire upon written
application to the board of trustees setting forth at what
time he or she desires to be retired, provided that the
member at the time specified for retirement has attained the
age of 50 or shall have completed 25 years of creditable
service, and notwithstanding that during the period of
notification the member may have separated from service.
The physician of the Department must have attained the age
of 65 in order to retire.

(II) A FORMER MEMBER WHO IS ELIGIBLE FOR A
SERVICE RETIREMENT ALLOWANCE AT THE TIME SERVICE IS
TERMINATED AND WHO HAS NOT WITHDRAWN HIS CONTRIBUTIONS MAY
RECEIVE THE SERVICE RETIREMENT ALLOWANCE AS OF THE FIRST DAY
OF THE MONTH FOLLOWING RECEIPT OF THE WRITTEN APPLICATION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1982.

Systems from creditable service to eligibility service.
