HARRY HUGHES, Governor                              3769

(B) IN ADDITION TO AND NOT IN DEROGATION OF ALL OTHER
POWERS, DUTIES, AND RESPONSIBILITIES OF THE LEGISLATURE, THE
FOLLOWING PROCESS SHALL BE APPLICABLE TO ANY STATE
DETERMINATION, AND NO SUCH DETERMINATION SHALL BE MADE
UNLESS THE REQUIREMENTS OF THIS SUBTITLE ARE FOLLOWED:

(1) PRIOR TO ANY STATE DETERMINATION THE
GOVERNOR SHALL SUBMIT THE PROPOSAL THEREFOR TO THE
LEGISLATIVE POLICY COMMITTEE. THE PROPOSAL SHALL BE
SUBMITTED AT LEAST 45 60 DAYS PRIOR TO THE DATE OF

DETERMINATION UNLESS, AS CIRCUMSTANCES WARRANT, THE

LEGISLATIVE POLICY COMMITTEE WAIVES THAT TIME PERIOD AND
ESTABLISHES A LESSER TIME PERIOD.

(2) THE LEGISLATIVE POLICY COMMITTEE SHALL

DETERMINE HOW THE GENERAL ASSEMBLY REVIEWS AND SUBMITS ANY
COMMENTS UPON THE PROPOSAL.

(2) THE LEGISLATIVE POLICY COMMITTEE MAY HOLD A
PUBLIC HEARING ON THE PROPOSAL AND/OR MAY REFER THE MATTER
TO A ANOTHER COMMITTEE FOR REVIEW.

(3) THE LEGISLATIVE POLICY COMMITTEE MAY SUBMIT
ANY COMMENTS ON BEHALF OF THE GENERAL ASSEMBLY TO THE
GOVERNOR WITHIN 45 60 DAYS OF RECEIPT OF THE PROPOSAL OR A
LESSER TIME PERIOD AS MAY BE ESTABLISHED BY THE LEGISLATIVE
POLICY COMMITTEE.

(4) IF THE LEGISLATIVE POLICY COMMITTEE PROVIDES
NO COMMENTS BY THE 45TH 60TH DAY AFTER RECEIPT OF THE
PROPOSALS OR A LESSER TIME PERIOD AS MAY BE ESTABLISHED BY
THE LEGISLATIVE POLICY COMMITTEE OR A LESSER TIME PERIOD AS

ESTABLISHED BY THE LEGISLATIVE POLICY COMMITTEE, THE

GOVERNOR MAY PROCEED TO MAKE THE STATE DETERMINATION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect June 1, 1982.
