In item (3) of this section, the former reference
to a part of a facility "used for or in
conjunction with the care, maintenance,
sustenance or treatment of such mentally retarded
persons" is deleted as unnecessary in light of
the use of the defined term "facility".

The only other changes are in style.

PART II. RECORDS.

7-610. REQUIREMENTS FOR KEEPING RECORDS.

(A)  REQUIRED RECORDS.

(1)  EACH FACILITY SHALL KEEP COMPLETE RECORDS
FOR EACH INDIVIDUAL WHO IS EVALUATED OR TREATED IN THE
FACILITY UNDER THIS TITLE.

(2)  THE RECORD SHALL CONTAIN ALL OF THE
INFORMATION THAT IS REQUIRED BY THIS TITLE OR THE
ADMINISTRATION.

(B)  STORAGE.

(1)  A PUBLIC FACILITY SHALL KEEP THE RECORDS IN
A SECURE AREA AT THE PUBLIC FACILITY.

(2)  A PRIVATE FACILITY SHALL KEEP THE RECORDS IN
A SEPARATE AREA AT:

(I)  THE PRIVATE FACILITY; OR

(II)  THE OFFICE OF THE PERSON WHO OPERATES
THE PRIVATE FACILITY.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
59A, § 17(b).

In subsection (a)(1) of this section, the
reference to individuals "evaluated or treated in
the facility" is substituted for "persons
admitted", to avoid the apparently unintended
implication of using a derivative of the defined
term "admission" — i.e., the implication that
