FOR the purpose of permitting authorizing the planning
commission to permit the chairman of the planning
commission, zoning administrator, or an equivalent
administrative official to approve certain plats of
minor subdivisions; requiring the approval to be
written on the plat; and generally relating to the
approval of minor subdivision plats by certain
officials.

BY repealing and reenacting, with amendments,

Section 5.02

Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article 66B - Zoning and Planning

5.02.

Whenever a local legislative body shall have adopted
the transportation element of the plan of the territory
within its subdivision jurisdiction or part thereof, and
shall have filed a certified copy of such plan in the office
of clerk of the circuit court of the county in which such
territory or part is located[, then]:

(1)   [no] A plat of a subdivision of land within
such territory or part [shall] MAY NOT be filed or recorded
until it shall have been approved by the planning commission
and such approval entered in writing on the plat by the
chairman or secretary of the commission[.]; AND

(2)   IF A PLAT OF A SUBDIVISION OF LAND WITHIN
THE TERRITORY OR PART CONTAINS 4 5 OR LESS LOTS, SITES,
OR OTHER DIVISIONS OF LAND, THE PLAT OF THE SUBDIVISION MAY
BE APPROVED BY THE PLANNING COMMISSION MAY AUTHORIZE THE
CHAIRMAN OF THE PLANNING COMMISSION, THE ZONING

ADMINISTRATOR, OR AN EQUIVALENT ADMINISTRATIVE OFFICIAL__TO

APPROVE THE PLAT OF THE SUBDIVISION. THE APPROVAL SHALL BE
ENTERED IN WRITING ON THE PLAT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1982.
