(7)  WHETHER THE GOVERNMENT ACTIVITY OPERATES IN
A FAIR AND NONDISCRIMINATORY MANNER IN FULL COMPLIANCE WITH
LEGAL REQUIREMENTS AND STATE POLICY; AND

(8)  WHETHER THE GOVERNMENT ACTIVITY OPERATES IN
THE MANNER WHICH IMPOSES THE LEAST NECESSARY BURDEN ON THE
CITIZENS AND ECONOMY OF THIS STATE THAT IS CONSISTENT WITH
THE PURPOSE FOR WHICH THE GOVERNMENT ACTIVITY WAS CREATED.

[(f)] (G) The evaluation report also may include any
other information provided for in the evaluation plan or
which the Department of Fiscal Services [deems] CONSIDERS
appropriate.

[(g)] (H) Before December 15 of the year preceding the
year of the evaluation date, the [legislative] PROGRAM
evaluation committee shall hold a public hearing to receive
testimony from the board OR GOVERNMENT ACTIVITY and the
public regarding the evaluation report prepared by the
Department of Fiscal Services.

[(h)] (I) On or before the twentieth day of the
regular session of the General Assembly in the year of
evaluation, the [legislative] PROGRAM evaluation committee
shall report to the General Assembly its recommendation to
reestablish, reconstitute with changes, repeal, or allow to
terminate the board OR GOVERNMENT ACTIVITY under evaluation.
This report shall be accompanied by a bill to effect the
recommendation, if legislation is appropriate.

488.

A board OR GOVERNMENT ACTIVITY [which] THAT is subject
to evaluation under this subtitle shall [upon], ON request,
promptly supply the Department of Fiscal Services and the
reviewing committees with all information [which] THAT is
requested and shall otherwise cooperate with the Department
and the committees in the evaluation.

489.

(a)  A member of a board OR GOVERNMENT ACTIVITY that is
reestablished [pursuant to] AS PROVIDED IN this subtitle
shall continue to hold office for the term for which the
member was appointed unless the law reestablishing the board
OR GOVERNMENT ACTIVITY provides to the contrary.

(b)  This subtitle [shall] IS not A REASON TO cause the
dismissal of any claim or right of a person or entity
against any board[,] OR GOVERNMENT ACTIVITY or any claim or
right of a board OR GOVERNMENT ACTIVITY repealed under this
subtitle[, which] THAT is subject to litigation. The State
shall assume all [such] OF THESE claims and rights.
