Ch. 460
Secretary of Agriculture to control the growth and
infestation of Multiflora Roses; providing that a
landowner maintain his land in accordance with certain
standards to prevent the spread of Multiflora Roses;
providing for a certain complaint process, notice of
violation, and management procedures; providing for the
enforcement of this Act; providing for the use of
certain funds; requiring certain actions by the State's
Attorney's Office; and generally relating to the
control of Multiflora Roses in this State.

under the new subtitle, "Subtitle 6. Multiflora

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

SUBTITLE 6. MULTIFLORA ROSE MANAGEMENT
9-601.
THE EXISTENCE OF GROWTH OF ROSA MULTIFLORA, COMMONLY
KNOWN AS MULTIFLORA ROSE, IS DECLARED TO MAY BE A PUBLIC AND
COMMON NUISANCE ON LAND USED FOR AGRICULTURAL PRODUCTION.
9-602.
A PERSON WHO OWNS LAND WHERE MULTIFLORA ROSE IS GROWN
SHALL MAINTAIN THE LAND IN ACCORDANCE WITH MANAGEMENT
TECHNIQUES PRESCRIBED BY THE DEPARTMENT TO PREVENT THE
SPREAD OF MULTIFLORA ROSE TO ADJOINING PROPERTY USED FOR
AGRICULTURAL PRODUCTION.

ON A SIGNED, WRITTEN COMPLAINT TO THE SECRETARY BY A
COUNTY RESIDENT, THE SECRETARY SHALL MAKE AN INVESTIGATION
TO DETERMINE THE EXTENT OF ANY MULTIFLORA ROSE INFESTATION
THAT VIOLATES THE PROVISIONS OF THIS SUBTITLE.
9-604.
(A) ON A DETERMINATION BY THE SECRETARY THAT A
VIOLATION OF THIS SUBTITLE EXISTS, THE SECRETARY SHALL GIVE
WRITTEN NOTICE TO THE LANDOWNER WHO SHALL TAKE ACTION WITHIN
