(8) ANY AGRICULTURAL ASSOCIATION OR AGRICULTURAL
EMPLOYER WHEN ENGAGING A FARM LABOR CONTRACTOR THROUGH THE
DEPARTMENT OF HUMAN RESOURCES.
(C) THE COMMISSIONER MAY PROMULGATE RULES AND
REGULATIONS AS ARE REASONABLY NECESSARY TO CARRY OUT THIS
SUBTITLE, CONSISTENT WITH THE REQUIREMENTS OF THE
ADMINISTRATIVE PROCEDURE ACT AND THE STATE DOCUMENTS LAW.
80B.
(A) (1) A PERSON MAY ONLY ACT AS A FARM LABOR
CONTRACTOR IN THIS STATE IF. THE PERSON HOLDS A VALID
CERTIFICATE OF REGISTRATION ISSUED BY THE COMMISSIONER.
(2) A REGISTERED FARM LABOR CONTRACTOR SHALL
CARRY AT ALL TIMES, WHILE ENGAGING IN FARM LABOR CONTRACTING
ACTIVITIES IN - MARYLAND, A VALID STATE CERTIFICATE OF
REGISTRATION AND SHALL EXHIBIT IT TO ALL PERSONS IN THIS
STATE WITH WHOM THE FARM LABOR CONTRACTOR INTENDS TO DEAL AS
A FARM LABOR CONTRACTOR OR UPON REQUEST BY AN AUTHORIZED
STATE OFFICIAL OR EMPLOYEE.
(3) A PHOTOGRAPH OF THE FARM LABOR CONTRACTOR
SHALL BE AFFIXED TO THE CERTIFICATE OF REGISTRATION.
(4) A CERTIFICATE OF REGISTRATION MAY NOT BE
TRANSFERRED OR ASSIGNED.
(5) A CERTIFICATE SHALL BE VALID FOR 12 MONTHS
FROM THE DATE OF ISSUANCE UNLESS SOONER SUSPENDED OR REVOKED
BY THE COMMISSIONER.
(B) THE COMMISSIONER, AFTER APPROPRIATE INVESTIGATION
AND APPROVAL, SHALL ISSUE A CERTIFICATE OF REGISTRATION TO
ANY PERSON WHO HAS FILED WITH THE COMMISSIONER A WRITTEN
APPLICATION CONTAINING THE FOLLOWING:
(1) INFORMATION STATING THE APPLICANT'S
PERMANENT PLACE OF RESIDENCE AND THE FARM LABOR CONTRACTING
ACTIVITIES FOR WHICH THE CERTIFICATE IS REQUESTED;
(2) INFORMATION STATING EACH ADDRESS AT WHICH
THE APPLICANT EXPECTS TO RESIDE WHILE IN MARYLAND;
(3) THE NAMES AND ADDRESSES OF AGRICULTURAL
EMPLOYERS AND AGRICULTURAL ASSOCIATIONS USING HIS SERVICES
IN MARYLAND;
(4) THE NAMES AND PERMANENT ADDRESSES OF ANY AND
ALL CUSTODIANS OF PAYROLL RECORDS REQUIRED TO, BE KEPT UNDER
THIS SUBTITLE;
(5) THE ESTIMATED NUMBER OF MIGRANT AGRICULTURAL
FARM WORKERS THE FARM LABOR CONTRACTOR INTENDS TO EMPLOY TO
PERFORM ANY FARM LABOR CONTRACTING ACTIVITY IN MARYLAND;
|
