LAWS OF MARYLAND

Ch. 442

RECRUITS, SOLICITS, HIRES, EMPLOYS, FURNISHES, TRANSPORTS,
OR HOUSES MIGRANT AGRICULTURAL WORKERS.

(2)  "AGRICULTURAL EMPLOYER" MEANS ANY PERSON WHO
OWNS OR OPERATES A FARM, PROCESSING ESTABLISHMENT, CANNERY,
PACKING SHED, OR WHO PRODUCES OR CONDITIONS SEED, AND WHO
EITHER RECRUITS, SOLICITS, HIRES, EMPLOYS, FURNISHES,
TRANSPORTS, OR HOUSES MIGRANT AGRICULTURAL WORKERS.

(3)  "AGRICULTURAL EMPLOYMENT" MEANS EMPLOYMENT
ON A FARM IN CONNECTION WITH THE CULTIVATION AND TILLAGE OF
THE SOIL, OR IN CONNECTION WITH DAIRYING, OR THE PRODUCTION,
CULTIVATION, GROWING, OR HARVESTING OF ANY AGRICULTURAL OR
HORTICULTURAL COMMODITIES, THE RAISING OF LIVESTOCK, BEES,
FURBEARING ANIMALS, OR POULTRY, AND ANY OTHER ACTIVITIES
RELATED TO THE OPERATION, MANAGEMENT, CONSERVATION, OR
MAINTENANCE OF THE FARM AND ITS TOOLS, EQUIPMENT, OR
MACHINERY. THE TERM ALSO INCLUDES THE HANDLING, PLANTING,
DRYING, PACKING, PACKAGING, PROCESSING, FREEZING, OR GRADING
PRIOR TO DELIVERY FOR STORAGE OF ANY AGRICULTURAL OR
HORTICULTURAL COMMODITY IN ITS UNMANUFACTURED STATE BY ONE
IN THE EMPLOY OF THE OWNER OR OPERATOR OF A FARM.

(4)  "COMMISSIONER" MEANS THE COMMISSIONER OF
LABOR AND INDUSTRY OR THE COMMISSIONER'S DESIGNEE;

(5)  "FARM" MEANS ANY STOCK, DAIRY, FURBEARING
ANIMAL, POULTRY, FRUIT, OR TRUCK FARM, RANCH, NURSERY,
ORCHARD, GREENHOUSE, OR OTHER SIMILAR STRUCTURE OR AREA USED
PRIMARILY FOR THE GROWING OR RAISING OF AGRICULTURAL OR
HORTICULTURAL COMMODITIES.

(6)  "FARM LABOR CONTRACTING ACTIVITY" MEANS
RECRUITING, SOLICITING, HIRING, EMPLOYING, FURNISHING,
TRANSPORTING, OR HOUSING ANY MIGRANT AGRICULTURAL WORKER.

(7)  "FARM LABOR CONTRACTOR" MEANS ANY PERSON,
OTHER THAN AN AGRICULTURAL EMPLOYER, AN AGRICULTURAL
ASSOCIATION, OR AN EMPLOYEE OF AN AGRICULTURAL EMPLOYER OR
AGRICULTURAL ASSOCIATION, WHO, FOR ANY MONEY OR OTHER
VALUABLE CONSIDERATION PAID OR PROMISED TO BE PAID, PERFORMS
ANY FARM LABOR CONTRACTING ACTIVITY.

(8)  "MIGRANT AGRICULTURAL WORKER" MEANS AN
INDIVIDUAL WHO IS EMPLOYED IN AGRICULTURAL EMPLOYMENT OF A
SEASONAL OR OTHER TEMPORARY NATURE. HOWEVER, THE TERM SHALL
NOT INCLUDE:

(I) ANY INDIVIDUAL WHO IS NOT, IN THE
COURSE OF EMPLOYMENT, ABSENT OVERNIGHT FROM HIS PERMANENT
PLACE OF RESIDENCE UNLESS HE IS TRANSPORTED, OR CAUSED TO BE
TRANSPORTED, BY HIS EMPLOYER A FARM LABOR CONTRACTOR OR HIS
AGENT TO OR FROM THE PLACE OF EMPLOYMENT BY MEANS OF A
DAY-HAUL OPERATION;
