(H) "DRIVER CERTIFICATE" MEANS A CERTIFICATE ISSUED BY
THE DEPARTMENT FOR A PERSON TO BE A CONTROLLED HAZARDOUS
SUBSTANCE VEHICLE DRIVER.

[(g)] (I) "Facility Permit" means a permit issued by
the Department to establish, operate, or maintain a
controlled hazardous substance facility.

[(h)] (J) "Hauler Certificate" means a certificate
issued by the Department that permits a person to be a
controlled hazardous substance hauler.

[(h)} (J) [(i)] (K) (1) "Hazardous Substance" means
any substance that:

(i) Conveys toxic, lethal, or other
injurious effects to plant, animal, or aquatic life;

(ii) May be injurious to human beings; or

(iii) Persists in the environment.

(2) "Hazardous Substance" includes any matter
identified as a "Hazardous Waste" by the Environmental
Protection Agency.

[(i)](K) "Hauler Certificate" means a certificate
issued by the Department that permits a person to be a
controlled hazardous substance hauler.

[(j)] (L) (1) "Low-level Nuclear Waste" means a
substance that:

(i) Contains or is contaminated with
radioactive material emitting primarily beta or gamma
radiation; and

(ii) Is neither transuranic waste nor
high-level nuclear waste.

[(k)] (M) "Low-level Nuclear Waste Facility" means a
controlled hazardous substance facility for low-level
nuclear waste.

[(1)] (N) "Low-level Nuclear Waste Facility Permit"
means a facility permit issued by the Department for a
low-level nuclear waste facility.

[(m)] (O) "Person" includes the federal government,
this state State, any county, municipal corporation, or
other political subdivision of this state State, and any of
their units.
