any program of instruction offered by a State institution
under the supervision of:

(i) The Juvenile Services Administration,
Mental Retardation AND DEVELOPMENTAL DISABILITIES
Administration, or Mental Hygiene Administration of the
Department of Health and Mental Hygiene;

SECTION 5. AND BE IT FURTHER ENACTED, That section(s)
of the Annotated Code of Maryland read(s) as follows:

Article - Education

8-411.

(c) Each county board:

(1) Is responsible for the identification of
handicapped children who need special educational services,
including any school age children in day care centers under
jurisdiction of the Mental Retardation AND DEVELOPMENTAL
DISABILITIES Administration; and

(b) (3) The following officials shall serve ex officio
and each may designate someone to serve in his place:

(i) The State Superintendent of Schools;

(ii) The Secretary of Health and Mental
Hygiene;

(iii) The Director of the Juvenile
Services Administration;

(iv) The [Commissioner of Mental Hygiene]
ASSISTANT SECRETARY FOR MENTAL HEALTH, MENTAL RETARDATION,
ADDICTIONS, AND DEVELOPMENTAL DISABILITIES;

(v) The Director of the Mental Retardation
AND DEVELOPMENTAL DISABILITIES Administration;

(vi) The Superintendent of Public
Instruction of Baltimore City; and

(vii) Two county superintendents of
schools from counties where a State hospital center or a
juvenile residential institution of the Department of Health
and Mental Hygiene is located, who shall be selected by the
State Superintendent of Schools.
