nurses, social workers, and other individuals with
responsibilities for drug abusers; and

(2) To promote public understanding, interest,
and support, shall provide public education on the nature
and results of drug abuse and on the possibilities of
prevention and rehabilitation.

9-302.

(a)  (1) The State Advisory Council consists of the
following 18 members:

(ii) As ex officio members:

1. The Assistant Secretary for
Mental Health [and] , MENTAL RETARDATION, Addictions , AND
DEVELOPMENTAL DISABILITIES.

(b)  The Director shall report to the Assistant
Secretary for Mental Health [and] , MENTAL RETARDATION,
Addictions , AND DEVELOPMENTAL DISABILITIES.

(d) (2) "Private group home" does not include:

(iii) Any facility that is regulated by
the Mental Retardation AND DEVELOPMENTAL DISABILITIES
Administration;

(b)  The Mental Hygiene Administration may ask the
Mental Retardation AND DEVELOPMENTAL DISABILITIES
Administration to accept an individual in or eligible for
admission to a mental health residential facility, if the
Mental Hygiene Administration finds that the individual
would be provided for more appropriately in a mental
retardation facility.

(c)  The Mental Retardation AND DEVELOPMENTAL
DISABILITIES Administration shall determine whether transfer
to a mental retardation facility is appropriate.

(d)  A dispute over a transfer of an individual from
the Mental Hygiene Administration to the Mental Retardation
AND DEVELOPMENTAL DISABILITIES Administration shall be
resolved, in accordance with procedures that the Secretary
sets, on request of:

(1) The Mental Retardation AND DEVELOPMENTAL

DISABILITIES Administration;
