(a) (1) The Director exercises the powers, duties, and
responsibilities of office subject to the authority of the
Secretary.

(2) THE DIRECTOR SHALL REPORT TO THE ASSISTANT
SECRETARY FOR MENTAL HEALTH, MENTAL RETARDATION, ADDICTIONS,
AND DEVELOPMENTAL DISABILITIES.

SUBTITLE 2A. NONRETARDED DEVELOPMENTALLY DISABLED
INDIVIDUALS.

PART I. COMPREHENSIVE PLAN.

7-2A-01.

THE SECRETARY SHALL:

(1)  DEFINE, FOR PURPOSES OF THIS SECTION,
NONRETARDED DEVELOPMENTAL DISABILITY; AND

(2)  PREPARE AND CARRY OUT A COMPREHENSIVE PLAN
OF DAY PROGRAMS AND RESIDENTIAL SERVICES FOR INDIVIDUALS
WITH A NONRETARDED DEVELOPMENTAL DISABILITY.

PART II.     GROUP HOMES.

7-2A-04.

IN PART II OF THIS SUBTITLE, THE TERM "NONRETARDED
DEVELOPMENTALLY DISABLED INDIVIDUAL" MEANS AN INDIVIDUAL
WHOSE DISABILITY:

(1)  IS ATTRIBUTABLE TO CEREBRAL PALSY, EPILEPSY,
AUTISM, DYSLEXIA, OR ANY OTHER NEUROLOGICAL MALFUNCTION OR
DISORDER;

(2)  CAN BE EXPECTED TO CONTINUE INDEFINITELY;
AND

(3)  IS A SUBSTANTIAL HANDICAP TO THE ABILITY OF
THE INDIVIDUAL TO FUNCTION NORMALLY IN SOCIETY.

7-2A-05.

(A)  THE SECRETARY SHALL ADOPT APPROPRIATE RULES AND
REGULATIONS FOR ESTABLISHING AND OPERATING GROUP HOMES FOR
NONRETARDED DEVELOPMENTALLY DISABLED INDIVIDUALS.

(B)  (1) THESE RULES AND REGULATIONS SHALL REQUIRE
SUPERVISION OF A RESIDENTIAL STAFF.
