(a) The State's attorneys in the several counties of
the State shall receive annually the respective salaries set
forth for performing the duties required of them by their
respective public local laws and by the public general laws,
and such expenses as are provided by law and by the current
practice in the several counties. The State's attorneys
shall receive annual payments for office, traveling and
other expenses. All payments for salaries and expenses
shall be made by the respective counties in equal monthly
installments unless otherwise specified. The salaries and
expenses are as follows:
(i) (1) In Charles County the State's Attorney's
salary shall be [$36,000 a year for services during the
calendar year 1983, $37,000 a year for services during the
calendar year 1984, $38,000 a year for services during the
calendar year 1985, and $39,000 a year for services during
the calendar year 1986.] 90 PERCENT OF THE SALARY OF A JUDGE
OF THE DISTRICT COURT OF MARYLAND. A SALARY INCREASE SHALL
TAKE EFFECT AT THE BEGINNING OF THE ELECTED TERM OF OFFICE
AND MAY NOT INCREASE DURING THAT TERM OF OFFICE. In
addition to the compensation provided for in this section,
the State's Attorney shall be entitled to reimbursement for
reasonable expenses during his performance of duties,
subject to the approval of the County Commissioners. Except
in connection with and in performance of duties as State's
Attorney, while in office the State's Attorney shall serve
full time and may not appear as counsel or represent any
party professionally before any court, board, commission, or
agency of this State or of any of its political
subdivisions, or otherwise engage in the private practice of
law.
(s) (1) (i) In St. Mary's County the State's
Attorney's salary is [$28,000 and shall be $32,000 for the
year 1983; $33,000 for 1984; $34,000 for 1985; and $35,000
for 1986] 80 90 PERCENT OF THE SALARY OF A JUDGE OF THE
DISTRICT COURT OF MARYLAND. A SALARY INCREASE SHALL TAKE
EFFECT AT THE BEGINNING OF THE ELECTED TERM OF OFFICE AND
MAY NOT INCREASE DURING THAT TERM OF OFFICE.
(ii) During his term of office, the
State's Attorney may not engage in the private practice of
law in any matter [whatsoever] AFTER DECEMBER 31, 1982.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
may not be construed to extend or apply to the salary of the
State's Attorney of St. Mary's County or the State's
Attorney of Charles County in office on the effective date
of this Act, but the provisions of this Act concerning the
salary of the State's Attorney of St. Mary's County or the
State's Attorney of Charles County shall take effect at the
beginning of the next following term of office.
