Anatomy Board - Control and Distribution of Bodies

FOR the purpose of allowing the Anatomy Board to waive
reimbursement of its costs for moving and embalming a
body upon a showing of hardship by certain persons;
establishing that a donated body is under the exclusive
control of the Anatomy Board and establishing
procedures for the handling of donated bodies; and
providing for the distribution of bodies or body parts
to certain medical study programs; and providing that
the right of a donor to provide by last will and
testament or by contract agreement for the ultimate
disposition and repose of his last remains is not
precluded by certain provisions of the Code.

BY repealing and reenacting, with amendments,

Section 5-406(c) and 5-407
Annotated Code of Maryland

(As enacted by Chapter ____ (H.B. 200) of the Acts

of the General Assembly of 1982)

BY adding to

Article - Health - General
Section 5-406.1 and 5-408.1
Annotated Code of Maryland

(As enacted by Chapter ____ (H.B. 200) of the

Acts of the General Assembly of 1982)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland

(as enacted by Chapter ____ (H.B. 200) of the Acts of the

General Assembly of 1982) read(s) as follows:

Article - Health - General

5-406.

(c) On expiration of 48 hours after death, the body
shall be under the exclusive control of the Board and shall
be embalmed properly by an individual whom the Board
designates. However, any relative or friend of a deceased
may claim the body and, on payment to the Board of its costs
of moving and embalming the body, shall receive it. THE
BOARD MAY WAIVE ITS COSTS UNDER THIS SECTION UPON A SHOWING
OF HARDSHIP BY THE RELATIVE OR FRIEND.

5-406.1.

(A) ANY PERSON WHO HAS CUSTODY OF A DONATED BODY
IMMEDIATELY SHALL NOTIFY THE CHAIRMAN OF THE BOARD.
