AN ACT concerning

Pesticide Applicator's Law - Inspection for Pests

FOR the purpose of granting clarifying the Maryland
Secretary of Agriculture the Agriculture's authority to
adopt standards governing property inspections and the
identification of pests under the Pesticide
Applicator's Law; and granting the Secretary the
authority to regulate persons who are in the business
of inspecting for, identifying or controlling pests in
the environment.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article - Agriculture

5-201.

(k) "Pest control consultant" means any person who
engages in the business of offering or supplying technical
advice or supervision, INSPECTING FOR OR IDENTIFYING PESTS,
or recommending the use of specific pesticides for the
purpose of controlling pests in or on water, AIR, land,
plants, [farm] structures, or animals.

The Secretary, by suitable administrative procedures
including public hearings, if appropriate, shall:

(1) Adopt rules and regulations governing the
storage, sale, distribution, exchange, use, and disposal of
