6-110. RESPONSIBILITIES OF AND LIMITATIONS ON SECRETARY.
(A) POLICIES OF SECRETARY.
THE ADMINISTRATION SHALL CARRY OUT THE POLICIES OF THE
SECRETARY AS TO ITS FUNCTIONS UNDER § 6-109 OF THIS
SUBTITLE.
(B) PLANS, PROPOSALS, AND PROJECTS.
THE POWER OF THE SECRETARY OVER PLANS, PROPOSALS, AND
PROJECTS OF UNITS IN THE DEPARTMENT DOES NOT INCLUDE THE
POWER TO DISAPPROVE OR MODIFY ANY DECISION OR DETERMINATION
THAT THE ADMINISTRATION MAKES UNDER AUTHORITY SPECIFICALLY
DELEGATED BY LAW TO THE ADMINISTRATION.
REVISOR'S NOTE: Subsection (a) of this section is new
language derived without substantive change from
the first clause of the third sentence of former
Article 52A, § 5(a).
Subsection (b) of this section is new language
derived without substantive change from the third
sentence of former Article 41, § 206(f).
Subsection (b) of this section is rephrased to
exclude the Administration from the general
powers of the Secretary under § 2-104(f) of this
article. Similar sections that limit the power
of the Secretary over units in the Department
appear elsewhere in this article. See the
General Revisor's Note to this article.
The second clause of the third sentence of former
Article 52A, § 5(a), which required the Director
to report to the Secretary, is deleted as
unnecessary in light of § 2-104(g) of this
article, which generally provides for reports
from units of the Department.
The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that the relationship of the Administration and
the Secretary is unclear. Subsection (a) of this
section requires the Administration to carry out
the policies of the Secretary in the areas of
predelinquent children and administration of
juvenile services and institutions. However,
subsection (b) of this section seems to give the
