(E) IMPORTER.

"IMPORTER" MEANS A RETAILER WHO IMPORTS BEDDING,
UPHOLSTERED FURNITURE, OR FILLING MATERIAL THAT IS
MANUFACTURED IN A FOREIGN COUNTRY.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
43, § 65(6).

The phrase "in a foreign country" is substituted
for the phrase "outside the United States or its
possessions or Puerto Rico" for brevity and
clarity.

(G) LICENSE.

"LICENSE" MEANS, EXCEPT AS OTHERWISE PROVIDED IN THIS
SUBTITLE, A LICENSE ISSUED BY THE DEPARTMENT UNDER THIS
SUBTITLE TO ENGAGE IN BUSINESS AS A DISINFECTOR, IMPORTER,
MANUFACTURER, RENOVATOR, SUPPLY DEALER, OR WHOLESALER.

REVISOR'S NOTE: This subsection is new language added
to avoid repetition of each of the types of
business licenses required under this subtitle.

(H) MAKE.

"MAKE" MEANS TO ALTER, FINISH, OR PREPARE BEDDING,
UPHOLSTERED FURNITURE, OR FILLING MATERIAL FOR SALE,
REGARDLESS OF WHETHER THE BEDDING, UPHOLSTERED FURNITURE, OR
FILLING MATERIAL IS COMPOSED OF NEW OR SECONDHAND MATERIAL.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
43, § 65(7).

The former term "manufacturer" is deleted as
unnecessary and potentially confusing. It
appears that it was intended that "manufacturer"
in former Article 43, § 65(7) actually read
"manufacture", since "manufacturer" was
alternatively defined in former Article 43, §
65(8).

(I) MANUFACTURER.

"MANUFACTURER" MEANS A PERSON WHO, USING EITHER NEW OR
SECONDHAND MATERIAL:

(1) MAKES WHOLLY OR PARTLY BEDDING OR
UPHOLSTERED FURNITURE; OR

(2) APPLIES THE UPHOLSTERY OR COVERING ON ANY
STRUCTURAL UNIT OF BEDDING OR UPHOLSTERED FURNITURE.
