A PERSON WHO VIOLATES ANY PROVISION OF THIS SUBTITLE OR
OF ANY RULE OR REGULATION ADOPTED UNDER THIS SUBTITLE IS
GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO:

(1) FOR A FIRST OFFENSE, A FINE NOT EXCEEDING
$500 OR IMPRISONMENT NOT EXCEEDING 3 MONTHS OR BOTH; OR

(2) FOR A SUBSEQUENT OFFENSE, A FINE NOT
EXCEEDING $1,000 OR IMPRISONMENT NOT EXCEEDING 1 YEAR OR
BOTH.

THE SECRETARY IS RESPONSIBLE FOR THE GENERAL CARE OF
THE SANITARY INTERESTS OF THE PEOPLE OF THIS STATE.

10-102. INVESTIGATION AND CONTROL OF NUISANCES.

THE SECRETARY SHALL INVESTIGATE ALL 'NUISANCES THAT
AFFECT THE PUBLIC HEALTH AND DEVISE MEANS FOR THE CONTROL OF
THESE NUISANCES.

after the first half of the third clause of the
first sentence of Article 43, § 2 and the second
