THE RULES AND REGULATIONS MAY RECOGNIZE A VARIATION:

(1) IN THE PRIMARY USE OR CONSTRUCTION OF WELLS;
AND

(2) OF THE MATERIALS PENETRATED IN DIFFERENT
LOCALITIES.

(C) COMMENT BY BOARD.

BEFORE THE DEPARTMENT ADOPTS ANY RULE OR REGULATION

THAT RELATES TO THE CONSTRUCTION OF WELLS, THE DEPARTMENT

SHALL SUBMIT THE PROPOSED RULE OR REGULATION TO THE BOARD
FOR COMMENT.

REVISOR'S NOTE: This section is new language derived
without substantive change from former NR §
8-602(b) and the third and sixth sentences of
(a).

The fourth sentence of former NR § 8-601(a),
which stated that the rules and regulations
adopted by the Department were to be effective on
January 1, 1979, is deleted as obsolete.

9-1306. PERMIT REQUIRED.

A PERSON MAY NOT DRILL A WELL IN THIS STATE UNLESS THE
DEPARTMENT ISSUES A PERMIT TO DRILL THE WELL.

9-1307. APPLICATIONS FOR AND CONDITIONS ON PERMITS.

(A)  APPLICATIONS.

IN APPLYING FOR A PERMIT TO DRILL A WELL, THE WELL
DRILLER SHALL GIVE THE DEPARTMENT ANY INFORMATION THE
DEPARTMENT REQUIRES.

(B)  CONDITIONS.

AS A CONDITION TO ISSUING A PERMIT TO DRILL A WELL, THE
DEPARTMENT MAY REQUIRE THAT SAMPLES OF THE MATERIALS
ENCOUNTERED IN DRILLING THE WELL BE PRESERVED AND SUBMITTED
TO THE DEPARTMENT.
