In subsection (c) of this section, the former
reference to payment of the compensation by this
State is deleted as unnecessary in light of
subsection (g) of this section.
In subsection (d) of this section, the phrase
"shall have an office in Baltimore City" is
substituted for "office ... shall be maintained
in a building ... as may be provided by the City"
to reflect that Baltimore City has transferred to
this State a building dedicated for the use of
these medical examiners.
In subsection (g) of this section, the defined
term "medical examiner" is substituted for the
limited reference to an examination by a "deputy
medical examiner", since the office of the Chief
Medical Examiner provides services for Baltimore
City. See revisor's note to § 5-306 of this
subtitle.
Also in subsection (g) of this section, the
former reference to the initial fiscal year for
this form of budget is deleted as obsolete.
The only other changes are in style.
As to subsection (a) of this section and the
staff of the Commission, see Ch. 575, § 2, Acts
of 1979. That Act changed the basis for funding
the Commission and, in Section 2 of that Act,
delineated the status of its employees as of a
certain date.
As to subsection (g) of this section, the
Commission to Revise the Annotated Code notes
that, under the executive budget system
established by Article III, § 52 of the State
Constitution, the Governor may omit from the
Budget Bill funding for a program, even if a
provision states that funding is to be included.
See Maryland Action for Foster Children, Inc. v.
State. 279 Md. 133, 367 A.2d 491 (1977). An
exception to this rule requires funding only if
a minimum level of funding is specified. See
Article III, § 52(11) of the State Constitution.
