(2) FILE THE RESOLUTION AMONG THE DORCHESTER
COUNTY LAND RECORDS.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 664A(b) and (c)(3), (4), and the third
sentence of (2).

In subsection (a) of this section, "from the date
the complete petition is filed" is substituted
for the former reference to rendering a decision
within "90 days from the date the petition is
filed with the commission or within 90 days from
the date the petitioner submits his map and
plans" for clarity. Under § 9-675(b) of this
subtitle, a "complete petition" must include the
map and plans.

In subsection (c) of this section, "30 days" is
substituted for "90 days" to correct an error
made in the published volume containing former
Article 43, § 664A(c)(4). Chapter 248, Acts of
1980, which enacted former Article 43, §
664A(c)(4), provided a 30-day appeal period.

9-677. ADOPTION OF RULES AND REGULATIONS.

(A) IN GENERAL.

THE SANITARY COMMISSION SHALL PROPOSE AND, WITH THE
APPROVAL OF THE DORCHESTER COUNTY COMMISSIONERS, GIVEN AFTER
A PUBLIC HEARING, SHALL ADOPT RULES AND REGULATIONS TO CARRY
OUT THE PROVISIONS OF THIS SUBTITLE THAT RELATE TO SHARED
FACILITIES.

(B) RULES AND REGULATIONS FOR CLASSIFICATION AND
ASSESSMENT OF PROPERTY.

THESE RULES AND REGULATIONS SHALL INCLUDE PROVISIONS
FOR:

(1) CLASSIFICATION OF PROPERTIES IN THE SHARED
FACILITIES AREA; AND

(2) LEVY OF BENEFIT ASSESSMENTS IN ACCORDANCE
WITH THIS SUBTITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 664A(h) and the first clause of the second
sentence of (e)(2).

Subsection (b)(1) of this section is new language
added to clarify that, before a benefit
assessment is made, property must be classified.
