2324                                      LAWS OF MARYLAND                                    Ch. 240

BEFORE THE DISTRICT CONDEMNS A PROPERTY RIGHT IN A
CEMETERY, THE SANITARY COMMISSION SHALL ADOPT A RESOLUTION
THAT:

(1) IS APPROVED BY A MAJORITY OF THE SANITARY
COMMISSIONERS APPOINTED FROM THE MEMBER COUNTY IN WHICH THE
CEMETERY IS LOCATED;

(2) INCLUDES A DECLARATION THAT THE CONDEMNATION
IS NECESSARY FOR THE PUBLIC HEALTH AND SAFETY; AND

(3) INCLUDES A DECLARATION THAT IMMEDIATE
ACQUISITION OF THE PROPERTY RIGHT IN THE CEMETERY IS
NECESSARY.

(D) SAME -- BURIAL OF LINES.

THE SANITARY COMMISSION SHALL BURY EVERY WATER LINE AND
SEWER LINE THAT IT BUILDS IN CEMETERY LAND.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 666A.

In subsection (a) of this section, the former
references to various types of property and
interest in property, such as "land",
"structures", "stream bed", "waterway", "fee",
and "easement" are deleted as included in "any
interest in real property".

Also in subsection (a) of this section, the
former reference to property located "within or
without a district" is deleted as unnecessary.

Also in subsection (a) of this section, the
former references to specific parts of projects,
such as a "water main", "sewage disposal plant",
"reservoir", and "tank" are deleted in light of
the broad definition of "project" or as
specifically included in the defined terms "water
system" and "sewerage system", which by
definition, are components of a "project".

In subsection (b) of this section, the former
reference to "either public or private"
cemeteries is deleted as exhaustive and,
therefore, unnecessary.

9-669. REMOVAL OF OBSTRUCTIONS TO PROJECTS.

(A) REMOVAL REQUIRED.

A PERSON WHO OWNS ANY STRUCTURE OR OBSTRUCTION THAT IS
ON, OVER, OR UNDER A WAY SHALL PROMPTLY MOVE THAT STRUCTURE
