(III) RECORD A COPY OF:

1. THE CORPORATE DOCUMENT; AND

2. THE CERTIFICATE OF APPROVAL.

(C) EFFECT OF APPROVAL BY STATE DEPARTMENT OF
ASSESSMENTS AND TAXATION.

WHEN THE STATE DEPARTMENT OF ASSESSMENTS AND TAXATION
ISSUES A CERTIFICATE OF APPROVAL UNDER THIS SECTION:

(1) THE CORPORATE DOCUMENT IS EFFECTIVE;

(2) THE DISTRICT EXISTS AS PROVIDED IN THE
CORPORATE DOCUMENT; AND

(3) THE CORPORATE DOCUMENT IS CONCLUSIVELY
PRESUMED TO HAVE BEEN ADOPTED LAWFULLY.

REVISOR'S NOTE: This section is new language derived
without substantive change from the fifth through
seventh sentences and the last clause of the
fourth sentence of former Article 43, § 646, the
second through fourth sentences and the last
clause of the first sentence of § 647(4), and the
sixth through eighth sentences and the last
clause of the fifth sentence of § 648.

The Commission to Revise the Annotated Code
suggests that the General Assembly may wish to
add to this subtitle a requirement that copies of
corporate documents be filed among the land
records of each member county. Presently, the
only place where these documents may be examined
is at the State Department of Assessments and
Taxation. That department keeps the corporate
documents described in this section the same way
it keeps corporate documents generally -- indexed
by name of the corporation.

9-618. REPORTING DISTRICT'S PRINCIPAL OFFICE AND CORPORATE
OFFICERS.

(A) NOTICE ON CREATION OF DISTRICT.

PROMPTLY AFTER IT IS CREATED AND ITS OFFICERS ARE
ELECTED, EACH DISTRICT SHALL NOTIFY THE STATE DEPARTMENT OF
ASSESSMENTS AND TAXATION OF:

(1) THE PRINCIPAL OFFICE OF THE DISTRICT; AND

(2) THE NAME AND ADDRESS OF EACH OFFICER OF THE
