(3) "WATER SYSTEM" INCLUDES ANY PROPERTY OR
PROPERTY RIGHT USED IN THE OPERATION OF THE WATER SYSTEM.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
43, § 645(f).

In paragraph (1) of this subsection, "that can"
is substituted for "used or useful or having the
present capacity for future use", for clarity.

In paragraph (3) of this subsection, the former
phrase "rights, easements and franchises" is
deleted as included in "property right".

REVISOR'S NOTE TO SECTION: Former Article 43, § 645(k),
which defined "federal agency", is deleted as
unnecessary.

THIS SUBTITLE DOES NOT APPLY TO:

(1) ANNE ARUNDEL COUNTY.

(2) CARROLL COUNTY.

(3) HARFORD COUNTY.
