(O) SOLID WASTE ACCEPTANCE FACILITY.

"SOLID WASTE ACCEPTANCE FACILITY" MEANS A FACILITY
WHOSE PRIMARY PURPOSE IS:

(1) DISPOSING OF SOLID WASTE;

(2) PROCESSING SOLID WASTE; OR

(3) TREATING SOLID WASTE.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
43, § 645(o).

In the introductory language of this subsection,
the former references to a "sanitary landfill",
an "incinerator", and a "transfer station" are
deleted as included in "facility".

(P) SOLID WASTE DISPOSAL SYSTEM.

(1) "SOLID WASTE DISPOSAL SYSTEM" MEANS A SYSTEM
THAT SYSTEMATICALLY OR ON A SCHEDULE COLLECTS SOLID WASTE
AND TRANSPORTS IT TO A SOLID WASTE ACCEPTANCE FACILITY FOR
TREATMENT OR DISPOSAL.

(2) "SOLID WASTE DISPOSAL SYSTEM" INCLUDES A
SOLID WASTE ACCEPTANCE FACILITY THAT IS USED WITH THE
SYSTEM.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
43, § 645(m).

In paragraph (1) of this subsection, the former
phrase "whether publicly or privately owned" is
deleted as exhaustive and, therefore,
unnecessary.

(Q) WATER SYSTEM.

(1) "WATER SYSTEM" MEANS A PLANT, SYSTEM,
FACILITY, OR PROPERTY THAT CAN SUPPLY WATER OR DISTRIBUTE
WATER.

(2) "WATER SYSTEM" INCLUDES THE FOLLOWING PARTS
OF A WATER SYSTEM:

(I) A DAM.

(II) A FILTRATION PLANT.

(III) A HYDRANT.
