9-208. ORDER FOR ALTERATIONS OR EXTENSIONS WHEN DEPARTMENT
FINDS IMPROVEMENT CANNOT BE MADE BY CHANGE OF MANNER OF
OPERATION; POWERS OF LOCAL HEALTH OFFICER.

(A)  ORDER BY DEPARTMENT.

(1) IF, AFTER INVESTIGATION, THE DEPARTMENT
FINDS THAT ANY WATER SUPPLY OR SEWERAGE SYSTEM, OR REFUSE
DISPOSAL WORKS IS IN ANY WAY A MENACE TO HEALTH OR COMFORT,
OR IS CREATING A NUISANCE, AND THAT CONDITIONS CANNOT BE
SUFFICIENTLY IMPROVED BY MERE CHANGE IN THE METHOD OF
OPERATION, THE DEPARTMENT MAY ISSUE AN ORDER REQUIRING THE
OWNER OF THE SYSTEM OR PLANT TO MAKE ALTERATIONS OR
EXTENSIONS TO THE SYSTEM OR PLANT, OR TO INSTALL A NEW
SYSTEM OR PLANT, AS THE DEPARTMENT FINDS NECESSARY TO
CORRECT IMPROPER CONDITIONS.

(2) THE DEPARTMENT SHALL SPECIFY IN ITS ORDER A
REASONABLE DATE FOR THE COMPLETION OF THE WORK.

(B)  ACTIONS BY LOCAL HEALTH OFFICER.

THE SECRETARY MAY AUTHORIZE A HEALTH OFFICER TO:

(1) CONDUCT INVESTIGATIONS OF REFUSE DISPOSAL
SYSTEMS; AND

(2) ENFORCE STATE REGULATIONS GOVERNING SUCH
SYSTEMS.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 392.

In the introductory language of subsection (b) of
this section, the former reference to "the
Baltimore City Commissioner of Health" is deleted
as unnecessary in light of the definition of
"health officer" in § 1-101 of this article.

The only other changes are in style.

9-209. INSTALLATION OF SYSTEM IF SECRETARY FINDS CONDITIONS
DANGEROUS TO HEALTH.

IF, AFTER INVESTIGATION, THE SECRETARY MAKES ANY OF THE
FOLLOWING FINDINGS, THE SECRETARY MAY ISSUE AN ORDER UNDER
THIS SECTION.
