(B) ADDITIONAL INFORMATION.

(1) THE SECRETARY MAY REQUEST ANY OTHER
INFORMATION AND RECORDS ABOUT THE WATER SUPPLY AND SEWERAGE
SYSTEMS OR REFUSE DISPOSAL PLANTS, AND THEIR MAINTENANCE AND
OPERATION, AS THE SECRETARY CONSIDERS APPROPRIATE.

(2) EVERY COUNTY, DISTRICT AUTHORITY,

MUNICIPALITY, CORPORATION, COMPANY, INSTITUTION, OR
INDIVIDUAL TO WHOM THE SECRETARY MAKES A REQUEST FOR
INFORMATION OR RECORDS UNDER THIS SUBSECTION SHALL FURNISH
THE INFORMATION OR RECORDS.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 390.

The former references to certain dates in 1914
are deleted as obsolete.

The only other changes are in style.

9-207. ORDER BY SECRETARY WHEN OPERATION INEFFICIENT;
ACTION BY SECRETARY IF RESULTS NOT PRODUCED.

(A) INVESTIGATION AND ORDER.

IF, AFTER INVESTIGATION, THE SECRETARY FINDS THAT,
BECAUSE OF INCOMPETENT SUPERVISION OR INEFFICIENT OPERATION,
A WATER SUPPLY OR SEWERAGE SYSTEM OR A REFUSE DISPOSAL WORKS
IS NOT PRODUCING SUCH RESULTS, FROM A SANITARY STANDPOINT,
AS MIGHT REASONABLY BE EXPECTED, OR IS IN ANY WAY A MENACE
TO HEALTH OR COMFORT OR IS CREATING A NUISANCE, THE
SECRETARY SHALL ISSUE AN ORDER TO THE PROPER OFFICER, BOARD,
DEPARTMENT, OR PERSON IN CHARGE OF OR OWNING THE SYSTEM OR
PLANT. THE ORDER SHALL REQUIRE THAT OPERATING RESULTS AS
MIGHT BE REASONABLY EXPECTED SHALL BE PRODUCED WITHIN A TIME
SPECIFIED BY THE SECRETARY.

(B) ACTION IF RESULTS NOT PRODUCED.

(1) IF THE REQUIRED RESULTS ARE NOT PRODUCED
WITHIN THE TIME SPECIFIED, THE SECRETARY MAY ORDER THE
PROPER OFFICER, BOARD, DEPARTMENT, OR PERSON IN CHARGE OF OR
OWNING THE SYSTEM OR PLANT TO APPOINT, WITHIN A TIME
SPECIFIED BY THE SECRETARY, A COMPETENT PERSON, WHO SHALL
TAKE CHARGE OF AND OPERATE THE SYSTEM OR PLANT, SO AS TO
SECURE THE RESULTS DEMANDED BY THE SECRETARY.

(2) THE PERSON APPOINTED UNDER THIS SUBSECTION
SHALL BE A PERSON APPROVED BY THE SECRETARY.

(3) THE OFFICER, BOARD, DEPARTMENT, OR PERSON
SERVED WITH THE ORDER UNDER THIS SUBSECTION SHALL PAY THE
SALARY OF THE PERSON APPOINTED UNDER THIS SUBSECTION.
