PROHIBITION THAT:

(I) IS ESTABLISHED UNDER FEDERAL LAW OR A
LAW OF THIS STATE; AND                                                   

(II) SPECIFIES QUANTITIES, RATES, OR
CONCENTRATIONS OF CHEMICAL, PHYSICAL, BIOLOGICAL, OR OTHER
CONSTITUENTS THAT ARE DISCHARGED INTO THE WATERS OF THIS
STATE.

(2) "EFFLUENT LIMITATION" INCLUDES:

(I) PARAMETERS FOR TOXIC AND NONTOXIC

DISCHARGES;
SOURCES; AND

(II) STANDARDS OF PERFORMANCE FOR NEW

(III) OCEAN DISCHARGE STANDARDS.

8-1401(d).

In paragraph (l)(ii) of this subsection, the
defined term "waters of this State" is
substituted for "state waters".

In paragraph (2)(iii) of this subsection,
"standards" is substituted for "criteria" for
clarity.

(E) INDUSTRIAL USER.

"INDUSTRIAL USER" MEANS:

(1)- A -PERSON -WHO IS ENGAGED IN MANUFACTURING,
FABRICATING, OR ASSEMBLING GOODS; OR

(2) A MEMBER OF ANY CLASS OF SIGNIFICANT
PRODUCERS OF POLLUTANTS IDENTIFIED UNDER RULES OR
REGULATIONS ADOPTED BY:

(I)  THE SECRETARY; OR

(II)  THE ADMINISTRATOR OF THE UNITED
STATES ENVIRONMENTAL PROTECTION AGENCY.

The word "goods" is new language added for
clarity and to conform to apparent legislative
intent.
