(B) CONTROLLED HAZARDOUS SUBSTANCE.

"CONTROLLED HAZARDOUS SUBSTANCE" MEANS:

(1)
IDENTIFIES AS
SUBTITLE; OR

ANY HAZARDOUS SUBSTANCE THAT THE DEPARTMENT
A CONTROLLED HAZARDOUS SUBSTANCE UNDER THIS

(2) LOW-LEVEL NUCLEAR WASTE.

REVISOR'S NOTE: Item (1) of this subsection is new
language derived without substantive change from
former NR § 8-1413.2(a)(2).

Item (2) of this subsection is new language added
to avoid repetition and to express what clearly
is implied, that this subtitle governs treatment,
storage, and disposal of all hazardous
substances, including those that are designated
low-level nuclear waste.

(C) CONTROLLED HAZARDOUS SUBSTANCE FACILITY.

(1) "CONTROLLED HAZARDOUS SUBSTANCE FACILITY"
MEANS A STRUCTURE, SYSTEM, OR PLACE IN WHICH CONTROLLED
HAZARDOUS SUBSTANCES ARE TREATED, STORED, OR DISPOSED OF.
DISPOSAL STRUCTURE, SYSTEM, OR GEOGRAPHIC AREA, DESIGNATED
BY THE DEPARTMENT FOR TREATMENT, STORAGE RELATED TO
TREATMENT OR DISPOSAL, OR DISPOSAL OF CONTROLLED HAZARDOUS
SUBSTANCES.

INCLUDES:

(2) "CONTROLLED HAZARDOUS SUBSTANCE FACILITY"

AND

(I) A LOW-LEVEL NUCLEAR WASTE FACILITY;

(II) AN OPERATING LANDFILL THAT, UNDER §
7-232(B) OF THIS SUBTITLE, HAS A PERMIT EQUIVALENT TO A
FACILITY PERMIT.
