YEAR, THE COUNCIL SHALL SUBMIT TO THE GOVERNOR AND THE
GENERAL ASSEMBLY A REPORT THAT:

(1)  DESCRIBES THE ACTIVITIES OF THE COUNCIL
DURING THE PREVIOUS YEAR; AND

(2)  INCLUDES ANY RECOMMENDATIONS THAT WOULD
ALLOW THE COUNCIL BETTER TO FULFILL ITS PURPOSES.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 813C (a) and (c).

The only changes are in style.

The attention of the General Assembly is called
to the fact that, under subsection (a)(4) of this
section, the Council may assist only State
agencies, private individuals, or private
organizations in developing grant proposals, and,
possibly, may not assist local agencies in this
way.

6-107. POWERS AND DUTIES OF THE SECRETARY.

(A)  DUTY TO REFER ISSUES TO COUNCIL.

THE . SECRETARY SHALL REFER TO THE COUNCIL FOR ADVICE
EACH SIGNIFICANT ISSUE THAT INVOLVES A TOXIC OR CARCINOGENIC
SUBSTANCE.

(B)  CONSULTANTS.

THE SECRETARY MAY ASK ANY PERSON WHO IS NOT A MEMBER OF
THE COUNCIL BUT WHO HAS EXPERTISE IN A PARTICULAR AREA TO
CONSULT WITH THE COUNCIL OR ANY COMMITTEE OF THE COUNCIL.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 813C(b) and (d).

In subsection (a) of this section, "toxic or
carcinogenic" is substituted for "toxic and
carcinogenic" to clarify that a substance need
not be both toxic and carcinogenic for this
subsection to apply.

In subsection (b) of this section, "committee" is
substituted for "subcommittee" for clarity.
