(2)  AT THE END OF A TERM, A MEMBER CONTINUES TO
SERVE UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.

(3)  A MEMBER WHO IS APPOINTED AFTER A TERM HAS
BEGUN SERVES ONLY FOR THE REST OF THE TERM AND UNTIL A
SUCCESSOR IS APPOINTED AND QUALIFIES.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 813B(b) and (a) -- except as the first
clause of the first sentence of (a) related to
establishment of the Council.

In subsection (a)(2)(iii) of this section, the
phrase "qualified individuals submitted to the
Governor" . is substituted for "persons
recommended".

In subsection (a)(3) of this section, the former
reference to "any other private or governmental
entity that the Governor deems appropriate" is
deleted as unnecessary.

Subsection (c)(3) of this section is standard
language added to this and, where necessary,
corresponding sections of other titles of this
article to provide for gaps in membership by
indicating that a member serves until a successor
takes office. This provision is supported by the
cases of Benson v. Mellor, 152 Md. 481 (1927) and
Grooms v. LaVale Zoning Board, 27 Md. App. 266
(1975).

The former reference to eligibility for
reappointment is deleted as unnecessary.

6-104. OFFICERS.

FROM AMONG ITS MEMBERS, THE COUNCIL SHALL ELECT A
CHAIRPERSON.

without substantive change from the second clause
of former Article 43, § 813B(d).

"From among its members" is new language added
for clarity and to conform to practice.
