Ch. 240

DISPENSED UNDER PRESCRIPTION.

A DANGEROUS HOUSEHOLD SUBSTANCE DISPENSED UNDER THE
PRESCRIPTION OF AN AUTHORIZED PRESCRIBER MAY BE PROVIDED IN
A PACKAGE THAT DOES NOT MEET THE CHILD RESISTANT PACKAGING
STANDARDS ADOPTED UNDER THIS SUBTITLE IF THE NONCOMPLYING
PACKAGE IS:

(1)  REQUIRED BY THE PRESCRIPTION; OR

(2)  REQUESTED BY THE PURCHASER.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 890(b).

The words "authorized prescriber" are substituted
for "physician, dentist, or other licensed
medical practitioner" for consistency with
terminology used elsewhere in this article and in
the Health Occupations Article.

5-312. RIGHT OF ENTRY; INSPECTION, AND SAMPLES.

(A)  ENTRY FOR PURPOSE OF INSPECTION.

AT ANY REASONABLE TIME, A REPRESENTATIVE OF THE
SECRETARY MAY ENTER AND INSPECT ANY ESTABLISHMENT IN WHICH
THE SECRETARY REASONABLY BELIEVES A DANGEROUS HOUSEHOLD
SUBSTANCE IS BEING MANUFACTURED, REPACKED, OR RELABELED.

(B)  CONDITIONS FOR ENTRY.

ON ENTERING ANY ESTABLISHMENT TO MAKE AN INSPECTION
UNDER THIS SECTION, THE REPRESENTATIVE OF THE SECRETARY
SHALL PRESENT APPROPRIATE CREDENTIALS TO THE OWNER,
OPERATOR, OR AGENT IN CHARGE.

(C)  SAMPLES.

DURING ANY INSPECTION UNDER THIS SECTION, THE
REPRESENTATIVE OF THE SECRETARY MAY OBTAIN A SAMPLE OF ANY
PRODUCT, PACKAGE, OR LABELING IN ANY REASONABLE MANNER.

43, § 891(d).

In subsection (a) of this section, the former
parenthetical "including pharmacies" is deleted
as included in "establishment".

In subsection (c) of this section, "a sample of
any product, package, or labeling" is substituted
