REVISOR'S NOTE: This subsection formerly appeared as
Article 43, § 273(a) and (b).

In subsection (b)(1) of this section, the former
word "vend" is deleted as included in "sell".

In subsection (b)(2) of this section, "put" is
substituted for the references to a drug or
medicine being "thrown, cast, deposited, dropped,
scattered or left", for clarity and brevity.

Also in subsection (b) of this section, "any part
of any house" is substituted for the language
"any house, porch, veranda, portico, or any other
part of any house", for clarity and brevity.

Also in subsection (b) of this section, the
former language "lawn, yard, or court" is
shortened to "yard", for clarity and brevity.

The only other changes are in style.

SUBTITLE 12. PENALTIES.

4-1201. CIVIL PENALTY.

A PERSON WHO VIOLATES ANY PROVISION OF PART II OF
SUBTITLE 9 OF THIS TITLE IS LIABLE TO A CIVIL PENALTY NOT
EXCEEDING $100 FOR EACH OFFENSE, PLUS COSTS INCLUDING
EXPENSES OF INSPECTION AND ANALYSIS, TO BE COLLECTED IN A
CIVIL ACTION BROUGHT BY THE DEPARTMENT.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause
of the first sentence of former Article 43, §
184.

"Department" is substituted for "any person
suing in the name of the State" for clarity and
consistency with other, similar provisions
elsewhere in this article. See, e.g., § 3-406 of
this article.

In this section and throughout this subtitle, the
catchline to each of the referenced sections,
parts, or subtitles is added as an aid to the
reader only. These catchlines are not intended
to be part of the substantive law (cf. Article 1,
§ 18 of the Code) and, for this reason, are
placed in brackets.

The former minimum civil penalty of $5 is deleted
as obsolete.
