4-1002. USE OF METHYL ALCOHOL FOR FLAVORING PROHIBITED.

(A)  MANUFACTURE.

A PERSON WHO IS ENGAGED IN MAKING, COMPOUNDING, OR
SELLING EXTRACTS, ESSENCES, OR OTHER FLUIDS THAT COMMONLY
ARE USED FOR FLAVORING FOOD MAY NOT USE OR PERMIT THE USE OF
METHYL ALCOHOL IN MAKING OR COMPOUNDING ANY EXTRACT,
ESSENCE, OR OTHER FLUID THAT COMMONLY IS USED FOR FLAVORING
FOOD.

(B)  SALE.

A PERSON MAY    NOT  SELL ANY EXTRACT, ESSENCE, OR OTHER

FLUID THAT COMMONLY     IS    USED FOR FLAVORING FOOD IF THE

EXTRACT, ESSENCE,     OR    OTHER FLUID CONTAINS ANY METHYL
ALCOHOL.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first and
second clauses of former Article 43, § 181.

Throughout this section, "food" is substituted
for "articles of food or drink" in light of the
definition of "food" in § 4-101 of this title.

Also throughout this section, the former
references to "wood alcohol" are deleted as
included in "methyl alcohol".

Also throughout this section, the former
references to "manufacturing" are deleted as
included in "making".

In subsection (a) of this section, "or" is
substituted for "and" in the language "making,
compounding, or selling", in conformity to
apparent legislative intent.

In subsection (b) of this section, the former
language "or offer for sale" is deleted in light
of § 4-102 of this title.
