expressly that the Secretary "shall" inspect
plants in this State and "may" inspect plants
outside of this State, and keeps the provision of
the former law that those plants that are not
inspected by the Secretary must meet local
requirements that are at least as stringent as
those under this subtitle.

4-810. ISSUANCE OF LICENSE.

THE SECRETARY SHALL ISSUE A LICENSE TO ANY APPLICANT
WHO MEETS THE REQUIREMENTS OF THIS SUBTITLE.

without substantive change from the last clause
of the first sentence of former Article 43, §
193(d).

4-811. SCOPE OF LICENSE.

WHILE IT IS EFFECTIVE, A LICENSE AUTHORIZES THE
LICENSEE TO MANUFACTURE FROZEN DESSERTS AND FROZEN DESSERT
MIXES AT THE MANUFACTURING PLANT IDENTIFIED IN THE LICENSE.

REVISOR'S NOTE: This section is new language derived
without substantive change from the references to
the scope of a license in the first sentence of
former Article 43, § 193(c), the third sentence
and the last half of the first sentence of (d)
and the first clause of (g).

4-812. TERM, RENEWAL, AND NONTRANSFERABILITY OF LICENSES.

(A)  TERM OF LICENSE.

A LICENSE EXPIRES ON THE FIRST ANNIVERSARY OF ITS
EFFECTIVE DATE, UNLESS THE LICENSE IS RENEWED FOR A 1-YEAR
TERM AS PROVIDED IN THIS SECTION.

(B)  RENEWAL NOTICE.

AT LEAST 1 MONTH BEFORE THE LICENSE EXPIRES, THE
SECRETARY SHALL SEND TO THE LICENSEE, BY FIRST CLASS MAIL TO
THE LAST KNOWN ADDRESS OF THE LICENSEE, A RENEWAL NOTICE
THAT STATES:

(1)  THE DATE ON WHICH THE CURRENT LICENSE
EXPIRES;

(2)  THE DATE BY WHICH THE RENEWAL APPLICATION
MUST BE RECEIVED BY THE SECRETARY FOR THE RENEWAL TO BE
ISSUED AND MAILED BEFORE THE LICENSE EXPIRES; AND

(3) THE AMOUNT OF THE RENEWAL FEE.
