The reference in subsection (b) of this section
to the Administrative Procedure Act is standard
language added to this and, where necessary,
corresponding sections of other subtitles of this
article. It demonstrates clearly the intended
application of the Administrative Procedure Act,
Article 41, § 244 et seq. of the Code to
administrative hearings under this section.

Subsection (c) of this section includes only
those provisions that appear to add to the
provisions of the Administrative Procedure Act.

PART III. STANDARDS AND HANDLING REQUIREMENTS FOR MILK
PRODUCTS.

4-422. STANDARDS FOR MILK.

(A)  RAW MILK SOLD BY MILK PRODUCER.

THE RAW MILK THAT A MILK PRODUCER SELLS SHALL BE RAW
MILK THAT:

(1)  IS OBTAINED BY THE COMPLETE MILKING OF A
HEALTHY COW OR GOAT;

(2)  IS UNADULTERATED, WHOLE, AND UNADJUSTED; AND

(3)  IS PRACTICALLY FREE OF COLOSTRUM.

(B)  PASTEURIZED MILK SOLD BY DISTRIBUTOR OR MILK
PROCESSOR.

THE PASTEURIZED MILK THAT A DISTRIBUTOR OR MILK
PROCESSOR SELLS SHALL BE PASTEURIZED MILK THAT:

(1)  IS UNADULTERATED;

(2)  CONTAINS AT LEAST 8.25 PERCENT MILK SOLIDS
THAT ARE NOT FAT; AND

(3)  CONTAINS AT LEAST 3.25 PERCENT BUTTERFAT
THAT IS NATURAL TO MILK.

REVISOR'S NOTE: This section is new language derived
without substantive change from the second ' and
third sentences of former Article 43, § 570(v)
and the standards for goat milk in the first
sentence of (w).
