paragraph — and the first, second, and third
sentences of the first paragraph of former
Article 43, § 572.
In subsection (b)(2) of this section, the defined
term "certified industry dairy, farm inspector" is
substituted for "fieldman" to conform to the term
used in the Grade A Pasteurized Milk Ordinance.
Also in subsection (b)(2) of this section, the
former phrase "to conduct certified farm
inspections" is deleted in light of the
definition of "certified industry dairy farm
inspector".
In subsection (b)(3) of this section, "milk
processor" is substituted for "milk plant"
because the permit is issued to the operator of a
milk plant — i.e., a "milk processor" — rather
than for the milk plant.
Former Article 43, § 572(7), which required a
permit for a producer-distributor is deleted.
Under the former law, a "producer-distributor"
was a milk producer who also distributed at
retail the raw milk obtained from the
producer-distributor's dairy farm. Former
Article 43, § 572(7) also prohibited any retail
sale of raw milk in Baltimore City and limited
the retail sale of raw milk outside Baltimore
City to producer-distributors who held permits in
1972. The provision for producer-distributor
permit holders outside Baltimore City no longer
applies as there are no permit holders still in
business, and, since a general prohibition of
retail sale of raw milk appears in § 4-434 of
this subtitle, former Article 43, § 572(7) is
obsolete and unnecessary.
4-411. QUALIFICATIONS OF APPLICANTS.
(A) IN GENERAL.
TO QUALIFY FOR A PERMIT, A PERSON SHALL COMPLY WITH THE
REQUIREMENTS OF THIS SUBTITLE AND THE RULES AND REGULATIONS
ADOPTED UNDER THIS SUBTITLE.
(B) QUALIFICATIONS FOR CERTIFIED INDUSTRY DAIRY FARM
INSPECTOR AND MILK TRUCK TANK OPERATOR.
IN ADDITION TO THE REQUIREMENTS OF SUBSECTION (A) OF
THIS SECTION, TO QUALIFY FOR A CERTIFIED INDUSTRY DAIRY FARM
INSPECTOR'S PERMIT OR A MILK TRUCK TANK OPERATOR'S PERMIT,
THE APPLICANT SHALL MEET THE REQUIREMENTS OF THE GRADE A
PASTEURIZED MILK ORDINANCE.
