4-404. STATE PREEMPTION.

(A)  LOCAL REGULATION PROHIBITED.

A POLITICAL SUBDIVISION MAY NOT REGULATE ANY MILK
PRODUCT THAT IS PRODUCED, PROCESSED, AND MANUFACTURED IN
ACCORDANCE WITH THIS SUBTITLE AND THE RULES AND REGULATIONS
ADOPTED UNDER THIS SUBTITLE.

(B)  STATEWIDE SALE.

ANY MILK PRODUCT THAT IS PRODUCED, PROCESSED, AND
MANUFACTURED IN ACCORDANCE WITH THIS SUBTITLE AND THE RULES
AND REGULATIONS ADOPTED UNDER THIS SUBTITLE MAY BE SOLD
ANYWHERE IN THIS STATE.

REVISOR'S NOTE: This section is new language derived
without substantive change from the third
sentence of former Article 43, § 569 1.

Throughout this section, "produced, processed,
and manufactured" is substituted for "produced,
processed, or manufactured" to reflect the
obvious legislative intent that milk products
sold in this State should conform to this
subtitle in all respects.

Also throughout this section,   "this subtitle" is

substituted for "the law"     for clarity and to

reflect the organizational     structure of this
article.

In subsection (a) of this section, the former
phrase "wherein the products are produced ... or
sold" is deleted as unnecessary.

4-405. INTERPRETATION OF LAW.

(A) FEDERAL REGULATIONS FOLLOWED.

EXCEPT AS OTHERWISE PROVIDED IN THIS SUBTITLE OR BY A
RULE OR REGULATION ADOPTED UNDER THIS SUBTITLE, THIS
SUBTITLE AND THE RULES AND REGULATIONS ADOPTED UNDER THIS
SUBTITLE SHALL BE INTERPRETED IN ACCORDANCE WITH THE GRADE A
PASTEURIZED MILK ORDINANCE.

(B) CERTIFIED COPY OF GRADE A PASTEURIZED MILK
