4-103. PENALTIES.

A PERSON WHO VIOLATES ANY PROVISION OF THIS SUBTITLE IS
GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A
FINE NOT EXCEEDING $1,000.

REVISOR'S NOTE: This section formerly appeared as the
second sentence of Article 43B, § 22(b).

Although former Article 43B, § 22(b) applied only
to violations of the provisions that relate to
confidential records of the Drug Abuse
Administration, this section is revised to apply
to violations as to any "confidential record"
under this subtitle, and the lesser penalties
that appeared in the second sentence of former
Article 43, § l-I(b) and the second sentence of
former Article 52A, § 8(c) are deleted.

In making this change, the Commission to Revise
the Annotated Code concluded that the
discrepancies in penalties resulted from
enactment at diverse times rather than an intent
to treat confidential records of specific units
differently. In this regard, the Commission
noted that the same confidential information
could be within the custody of several units, and
violations in disclosing that record should be
subject to a uniform penalty.
