SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article 41 - Governor - Executive and Administrative

Departments

244.

For the purpose of this subtitle:

(a) "Agency" means any State board, commission,
department or officer authorized by law to make rules or to
adjudicate contested cases, except those in the legislative
or judicial branches, and the Governor, and except the
Maryland Parole Commission, the Workmen's Compensation
Commission, the State Accident Fund, the State Insurance
Department of Maryland, the Public Service Commission, the
Employment Security Board and the State Tax Commission. The
Maryland Automobile Insurance Fund shall not be considered
an "agency" within the meaning of this section as to any
matter or action with regard to which the Insurance
Commissioner has made an express, written finding or
determination that compliance with the provisions of the
Administrative Procedure Act by the Maryland Automobile Fund
is unnecessary. "Agency" also includes any agency created
by general law, which operates in two or more political
subdivisions.

(B) "BUSINESS" MEANS ANY TRADE, BUSINESS, OR
PROFESSIONAL ENTITY OR ACTIVITY CONDUCTED FOR PROFIT.

[(b)] (C) "Rule" includes every regulation, standard,
guideline, or statement of policy or interpretation of
general application and future effect, including the
amendment or repeal thereof, adopted by an agency, whether
with or without prior hearing, to implement or make specific
the law enforced or administered by it or to govern its
organization, procedure, or the practice before such agency,
but does not include regulations concerning only the
internal management of the agency and not directly affecting
the rights of or procedures available to the public,
responses to petitions for adoption of rules issued pursuant
to Section 248 of this article, or declaratory rulings
issued pursuant to Section 250 of this article.

[(c)] (D) "Contested case" means a proceeding before
an agency in which the legal rights, duties, statutory
entitlements, or privileges of specific parties are required
by law or constitutional right to be determined after an
agency hearing.
