(vii) Supplemental agreements with respect
to any of these; and

(viii) Orders.

(2) "Contract" does not include:

(i) Collective bargaining agreements with
employee organizations; [or]

(ii) Medicaid, judicare, or similar

reimbursement contracts for which user eligibility and cost
are set by law or by rules and regulations; OR

(III) HUMAN SERVICE AGREEMENTS BY WHICH
THE STATE AWARDS FINANCIAL SUPPORT TO ELIGIBLE PROVIDERS, IF

THE AGREEMENT:

1. IS BASED ON AN APPROVED BUDGET
AND SERVICE PLAN; AND

2. IS FOR THE PRIMARY PURPOSE OF

PROVIDING HEALTH RELATED, HABILITATIVE, OR REHABILITATIVE
SERVICES TO MARYLAND RESIDENTS.

(c) Under the coordination of the Governor, each
department shall adopt regulations, consistent with this
article, concerning:

(1)  Prequalification, suspension,

disqualification, and reinstatement of prospective bidders
and offerors;

(2)   Small procurement procedures;

(3)  Conditions and procedures for the

procurement of perishables and items for resale;

(4)  Conditions and procedures for the

procurement of supplies, services, or construction financed
by federal contracts or grants;

(5)  Conditions and procedures for cooperative
procurement;

(6)  Conditions and procedures for procurement by
State agencies which is financed by revenue bonds;

(7)  Conditions, including emergencies, and
procedures under which procurement may be made by means
other than competitive sealed bidding;
