2. A WRITTEN AGREEMENT FOR THE USE
OF THE VEHICLE IS IN EFFECT BETWEEN THE DRIVER AND THE
BUSINESS;

2.  THE DRIVER IS PAID ON A
COMMISSION BASIS ONLY;

3.  THE DRIVER HAS THE RIGHT
INITIALLY TO ESTABLISH THE DRIVER'S OWN WORKING HOURS; AND

4.  THE AGREEMENT WRITTEN AGREEMENT
BETWEEN THE DRIVER AND THE ENTITY THAT IS ENGAGED IN THE
MESSENGER SERVICE DELIVERY BUSINESS EXPRESSLY AND
PROMINENTLY PROVIDES THAT THE DRIVER IS AWARE:

A.  THAT THE DRIVER IS RESPONSIBLE
FOR PAYMENT OF ESTIMATED SOCIAL SECURITY TAXES AND STATE AND
FEDERAL INCOME TAXES;

B.  THAT THE SOCIAL SECURITY TAX
PAYABLE BY THE DRIVER IS HIGHER THAN THE SOCIAL SECURITY TAX
THE DRIVER WOULD OTHERWISE PAY; AND

C.  THAT THE WORK IS NOT COVERED
EMPLOYMENT UNDER THIS ARTICLE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1982.

AN ACT concerning

Cecil County - Fines and Forfeitures - Court Library

FOR the purpose of increasing the total payment to the Cecil
County Court Library for the use of the court library
from fines imposed and recognizances forfeited.

Cecil County - Court Library Funding

FOR the purpose of increasing the total payment to the clerk

of the Circuit Court for Cecil County for the use of
the court library; providing an additional funding
source for the Cecil County Court Library; providing
that certain attorney appearance fees shall be retained
