CHAPTER 133

(Senate Bill 468)

AN ACT concerning

Messenger Services Drivers - Unemployment
Coverage - Exemption

FOR the purpose of exempting certain drivers for messenger
services operations from coverage under the
unemployment insurance law; requiring as a condition
for the exemption certain conditions between the
parties and disclosure of the condition to the drivers;
and generally relating to an exemption from
unemployment insurance coverage for certain messenger
service drivers.

Article 95A - Unemployment Insurance Law

Section 20(g)(6)(vi)

Annotated Code of Maryland

(1979 Replacement Volume and 1981 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article 95A - Unemployment Insurance Law

20.

As used in this article, unless the context clearly
requires otherwise:

(g) (6) Services performed by an individual for wages
or under any contract of hire shall be deemed to be
employment subject to this article, irrespective of whether
the common-law relationship of master and servant exists,
unless and until it is shown to the satisfaction of the
Executive Director that:

(VI) AN INDIVIDUAL, PARTNERSHIP,
CORPORATION, OR OTHER ENTITY THAT IS ENGAGED IN THE
MESSENGER SERVICE DELIVERY BUSINESS IS NOT REQUIRED TO
COMPLY WITH SUBPARAGRAPHS (I), (II) AND (III) OF THIS
PARAGRAPH IF IT IS SHOWN TO THE SATISFACTION OF THE
EXECUTIVE DIRECTOR THAT:

1. THE MESSENGER SERVICE BUSINESS
DRIVERS PROVIDE THEIR OWN VEHICLES OR THE DRIVERS PAY TO THE
BUSINESS A STIPULATED AMOUNT FOR THE USE OF THE VEHICLE;
