(C) ASSISTANT SECRETARY
ADDICTIONS.

(1) THE SECRETARY SHALL APPOINT
SECRETARY FOR MENTAL HEALTH AND ADDICTIONS.

HEALTH AND

AN ASSISTANT

(2) THIS ASSISTANT
PLEASURE OF THE SECRETARY.

SECRETARY SERVES AT THE

LEAST:

(3)  THIS ASSISTANT SECRETARY SHALL HAVE AT

(I)  A BACCALAUREATE DEGREE; AND

(II)  EXPERIENCE IN HEALTH ADMINISTRATION.

(4)  THIS ASSISTANT SECRETARY IS ENTITLED TO THE
SALARY PROVIDED IN THE STATE BUDGET.

(5)  NOTWITHSTANDING ANY OTHER LAW, RULE, OR
REGULATION:

(I)  THIS ASSISTANT SECRETARY IS
RESPONSIBLE TO THE SECRETARY FOR ALL OF THE FUNCTIONS,
ADMINISTRATION, AND OPERATION OF THE MENTAL HYGIENE, DRUG
ABUSE, AND ALCOHOLISM CONTROL ADMINISTRATIONS PROVIDED BY
LAW OR BY RULES OR REGULATIONS OF THE DEPARTMENT; AND

(II)  ALL EDUCATIONAL AND TRAINING
FUNCTIONS OF THE DRUG ABUSE AND ALCOHOLISM CONTROL
ADMINISTRATIONS SHALL BE ADMINISTERED IN THE OFFICE OF THIS
ASSISTANT SECRETARY BY A DIRECTOR OF EDUCATION AND TRAINING.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
41, § 206D.

Under a reorganization plan approved by the
Governor, the Secretary made this Assistant
Secretary responsible for the Department
functions in the areas of mental retardation and
developmental disabilities and administratively
renamed this Assistant Secretary as "Assistant
Secretary for Mental Health, Mental Retardation,
Addictions, and Developmental Disabilities". For
a discussion of the authority to effect this
reorganization, see Opinion No. 80-081 (November
6, 1980) (unpublished).

The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that this reorganization is not reflected in this
article, since doing so might preclude a further
