Ch. 21

(1)  THE SECRETARY SHALL APPOINT AN ASSISTANT
SECRETARY FOR ENVIRONMENTAL PROGRAMS.

(2)  THIS ASSISTANT SECRETARY SERVES AT THE
PLEASURE OF THE SECRETARY.

(3)  THIS ASSISTANT SECRETARY IS ENTITLED TO THE
SALARY PROVIDED IN THE STATE BUDGET.

(4)  THIS ASSISTANT SECRETARY HAS THE DUTIES
PROVIDED BY LAW OR DELEGATED BY THE SECRETARY. THIS
ASSISTANT SECRETARY IS RESPONSIBLE TO THE SECRETARY FOR
ADMINISTERING AND ENFORCING THOSE ENVIRONMENTAL REGULATORY
FUNCTIONS ASSIGNED OR DELEGATED TO THIS ASSISTANT SECRETARY
SO AS TO ENSURE PRESERVATION, CONSERVATION, ENHANCEMENT,
WISE USE, AND PERPETUATION OF THE NATURAL RESOURCES OF THIS
STATE FOR THE GREATEST BENEFIT TO THIS STATE AND ITS
CITIZENS.

REVISOR'S NOTE: Paragraphs (1) and (4) of this
subsection are new language derived without
substantive change from former Article 41, §
206(c)(2) and former Article 43, § lFi.

Paragraphs (2) and (3) of this subsection are new
language added for clarity and conformity to the
provisions in subsection (c)(2) and (4) of this
section, as to the Assistant Secretary for Mental
Health and Addictions. Note that, under
subsection (d)(2) of this section, each assistant
secretary serves at the pleasure of the
Secretary.

In paragraph (4) of this subsection, the phrase
"is responsible to the Secretary for
administering ... functions assigned or delegated
to this Assistant Secretary" is new language
added to clarify that, while former Article 41, §
206(c)(3)(i) mandated that the Secretary delegate
to this Assistant Secretary those environmental
regulatory functions transferred to the Secretary
under Chs. 27 and 815, Acts of 1980, the exercise
of these responsibilities is subject to the
authority of the Secretary. In the Health
Occupations Article, specific reference to the
Assistant Secretary for Environmental Programs is
added in those provisions that relate to the
transferred functions. Therefore, former Article
41, § 206(c)(3)(i) is deleted as unnecessary.

Former Article 41, § 206(c)(3)(ii), which
provided that the transferred functions are in
addition to other delegated functions, also is
deleted as unnecessary.
