General Fund Appropriation,
provided that no State funds

shall be expended or

positions be established for
the Motor Vehicle Emissions
Inspection Program except
upon the adoption of a
resolution by the Board of
Public Works certifying that
the State has received
notification of a final and

imminent reduction of

significant federal funding
as a result of delays in the
implementation of the Motor
Vehicle Emissions Inspection

Program. The Board of

Public Works may not adopt
this certification unless

all reasonable

administrative and judicial
remedies have been exhausted
to avoid the loss of federal
funds. Additionally, it is

the intent of the

Legislature that no funds
shall be expended in payment
of claim settlement for this

purpose without being

appropriated in the annual
State budget as prescribed
in Article 21, Section 7-104
of the Annotated Code of
