(3) ASSESS EACH FACILITY ON OR BEFORE APRIL 30
OF EACH FISCAL YEAR.                       

(C) ON OR BEFORE JULY 1 OF EACH YEAR, EACH FACILITY
ASSESSED UNDER THIS SECTION SHALL MAKE PAYMENT TO THE
COMMISSION. THE COMMISSION SHALL MAKE PROVISIONS FOR
PARTIAL PAYMENTS.

(D) ANY BILL NOT PAID WITHIN 30 DAYS OF THE AGREED
PAYMENT DATE MAY BE SUBJECT TO AN INTEREST PENALTY TO BE
DETERMINED BY THE COMMISSION.

SECTION 2. AND BE IT FURTHER ENACTED, That all
employees of the Maryland State Health Planning and
Development Agency shall be transferred to and become
employees of the Maryland Health Resources Planning
Commission, without any diminution in salary or benefits;
all property, funds, assets, liabilities, contracts,
documents, and records of the Maryland State Health Planning
and Development Agency shall be transferred to and become
the property, funds, assets, liabilities, contracts,
documents, and records of the Maryland Health Resources
Planning Commission; all references in the Annotated Code of
Maryland and any other law, ordinance, bylaw, rule,
regulations, order, directive, or document to the Maryland
State Health Planning and Development Agency shall be deemed
to refer to the Maryland Health Planning Commission created
by this Act; and all rules, regulations, orders, and
directives of the Maryland State Health Planning and
Development Agency shall remain in effect as rules,
regulations, orders, and directives of the Maryland Health
Resources Planning Commission until changed by the Maryland
Health Planning Commission.

SECTION 3. AND BE IT FURTHER ENACTED, That the
provisions of this Act shall not be construed to alter or
diminish the powers and duties of the Department of State
Planning under Articles 41 and 88C of the Code.

SECTION 4. AND BE IT FURTHER' ENACTED, That if the
Governor finds that any provision of this Act fails to meet
conditions for receipt of federal funds under the Federal
Act the Governor by. executive order may make necessary
changes to enable the State to receive such funds.

SECTION 5. AND BE IT FURTHER ENACTED, That for the
State fiscal year 1983 only the Commission shall assess each
facility on or before October 31,1982, and each facility
shall make payment to the Commission on or before December
31, 1982, and that the income earned in accordance with this
