HARRY HUGHES, Governor

1315

(III) A KIDNEY DISEASE TREATMENT FACILITY,
AS DEFINED BY RULE OR REGULATION OF THE UNITED STATES
DEPARTMENT OF HEALTH AND HUMAN SERVICES;

(IV) AN AMBULATORY SURGICAL FACILITY THAT:

1. PROVIDES SURGICAL TREATMENT TO
INDIVIDUALS WHO DO NOT NEED OVERNIGHT HOSPITALIZATION;

2. IS NOT PART OF A HOSPITAL; AND

3. IS NOT PART OF THE OFFICE OF 1 OR
MORE PRIVATE PHYSICIANS OR DENTISTS OR PART OF ANY OFFICE OF
PHYSICIANS OR DENTISTS WHO ARE ORGANIZED AS A PROFESSIONAL
ASSOCIATION.

(V) AN INPATIENT FACILITY THAT IS
ORGANIZED PRIMARILY TO HELP IN THE REHABILITATION OF
DISABLED INDIVIDUALS, THROUGH AN INTEGRATED PROGRAM OF
MEDICAL AND OTHER SERVICES PROVIDED UNDER COMPETENT
PROFESSIONAL SUPERVISION; AND

(VI)  A HOME HEALTH AGENCY, AS DEFINED IN
SECTION 19-401 OF THIS TITLE;

(VII) A HOSPICE, AS DEFINED IN SECTION
19-901 OF THIS TITLE; AND

(VIII) ANY OTHER HEALTH INSTITUTION,
SERVICE, OR PROGRAM FOR WHICH PART I OF THIS SUBTITLE
REQUIRES A CERTIFICATE OF NEED.

(2) "HEALTH CARE FACILITY" DOES NOT INCLUDE A
HOSPITAL OR RELATED INSTITUTION THAT IS OPERATED, OR IS
LISTED AND CERTIFIED, BY THE FIRST CHURCH OF CHRIST
SCIENTIST, BOSTON, MASSACHUSETTS.

(F) "HEALTH SERVICE AREA" MEANS AN AREA OF THIS STATE
THAT THE GOVERNOR DESIGNATES AS APPROPRIATE FOR PLANNING AND
DEVELOPING OF HEALTH SERVICES.

(G) "LOCAL HEALTH PLANNING AGENCY" MEANS A BODY THAT
THE COMMISSION DESIGNATES TO PERFORM HEALTH PLANNING AND
DEVELOPMENT FUNCTIONS FOR A HEALTH SERVICE AREA.

19-102.

(A) (1) THE GENERAL ASSEMBLY FINDS THAT IT IS A
PRIORITY OF THIS STATE TO PROMOTE THE DEVELOPMENT OF A
HEALTH CARE SYSTEM THAT PROVIDES, FOR ALL CITIZENS,
FINANCIAL AND GEOGRAPHIC ACCESS TO QUALITY HEALTH CARE AT A
REASONABLE COST.

(2) THE CITIZENS OF THIS STATE HAVE A
FUNDAMENTAL INTEREST IN PLANNING THE DEVELOPMENT OF QUALITY
HEALTH SERVICES WITHIN EACH HEALTH SERVICE AREA.
