(2) The Council:

(i) Shall send to each health systems
agency for review and comment a copy of the proposed
budgetary priorities that affect the health service area for
which the health systems agency is responsible; and

(ii) As soon as possible, shall submit to
the Secretary its comments on the proposed program and
budgetary priorities.]

(a)  Plans, proposals, and projects.

The power of the Secretary over plans, proposals, and
projects of units in the Department does not include the
power to disapprove or modify any decision or determination
that the State agency or Council makes under authority
specifically delegated by law to the State agency or
Council.

(b)   Staff, functions, and funds.

The power of the Secretary to transfer by rule,
regulation, or written directive, any staff, functions, or
funds of units in the Department does not apply to any
staff, function, or funds of the State agency or Council.]

In addition to the duties set forth elsewhere in Part I
of this subtitle or in the Federal Act, the Governor shall
direct, as necessary, a State officer or agency to cooperate
with the State agency or the Council in carrying out its
functions.]

The Governor shall:

(1)  Designate the health service areas in this
State in accordance with the Federal Act; and

(2)  Consult with the United States Secretary of
Health and Human Services on the Secretary's designation of
health systems agencies for those health service areas.]
