Section 19-101 through 19-116
Annotated Code of Maryland

(As enacted by Chapter ___ (H.B. 200) of the

Acts of the General Assembly of 1982)

FOR the purpose of repealing the provisions relating to the
State Health Planning and Development Agency, the
Statewide Health Coordinating Council, health service
areas, and health system agencies and their duties,
including provision as to the structure of the State
Agency, its powers and duties, the power of the
Secretary of the Department of Health and Mental
Hygiene as to the State Agency, the duty of the
Governor as to health system agencies; repealing the
requirements for a certificate of need, including the
requirements for hearings and appeals; creating the
Health Resources Planning Commission; stating the.
purposes of the Act; defining terms; specifying powers
and duties of the Commission; specifying composition
and qualifications of the Commission and conduct of
meetings; providing for staffing; providing for the
establishment of a method of financing the Commission;
for the acceptance of funds; specifying the duties of
the Governor; specifying the duties of the Secretary;
requiring the issuance of a certificate of need by the
Commission in order to operate certain health care
projects; providing for the appeal of decisions by the
Commission; providing for health service areas and
regional agencies; providing for the preparation and
adoption of a State health plan; providing for
coordination among agencies; providing for the transfer
of employees and assets and liabilities of the State
Health Planning and Development Agency to the
Commission; providing for an orderly transition of
responsibilities from the State Health Planning and
Development Agency to the Commission; and generally
relating to the administration of the State's health
planning and development function pursuant to relevant
federal requirements and State law.
